Roomcart Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Great Dane Holdings LLC, a Wyoming limited liability company (“Roomcart,” “we,” “us,” or “our”), governing your use of the Roomcart mobile app (the “App”). Please read them carefully. By using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. Roomcart is currently offered only in the United States. By using the App you represent that you meet these requirements.

2. What Roomcart does

Roomcart lets you photograph a room, generate an AI “restyle” of that room, and shop for products that resemble items shown in the render.

• Renders are AI-generated approximations, not photographs of real products. The App aims to preserve the structure of your room (walls, windows, doors, dimensions) and to change only finishes and furnishings, but AI output can be imperfect. Do not rely on a render for structural, measurement, fit, or purchasing decisions without independently confirming details with the merchant.
• Product matches are labeled by how closely they correspond to the render — for example “similar style,” “styled with this item,” or “this item.” A “similar” match is a design suggestion, not a guarantee that the pictured object is that exact product.
• The shopping features always work, on free and paid renders alike. We never put the ability to view product matches or tap out to a merchant behind a paywall.

3. Your account

You are responsible for activity under your account and for keeping your login secure. Notify us promptly of any unauthorized use.

4. Your free render, subscriptions, and purchases

Every new account includes one free render — a single, one-time render so you can see what the App does with your own room. After you have used your free render, generating additional renders requires an active Roomcart Plus subscription (or free trial) or purchased render units. Generating renders is what a subscription unlocks; shopping never requires payment — product matches, product sheets, and merchant links keep working on every render you have, free or paid (see §2).

Roomcart offers the following digital purchases:

• Roomcart Plus (Weekly) — an auto-renewing weekly subscription. Includes a 3-day free trial for new subscribers; after the trial, the subscription price (currently $9.99 per week) is charged unless you cancel at least 24 hours before the trial ends.
• Roomcart Plus (Annual) — an auto-renewing annual subscription (currently $79 per year).
• Project Pack — a one-time, non-renewing purchase of a fixed number of render units.
• Top-ups — one-time consumable render units.

The price displayed in the App at the time of purchase is authoritative; prices may vary by storefront and may change prospectively.

Subscription allowance and fair use. A Roomcart Plus subscription includes a generous allowance of render generations each billing period, subject to fair-use limits shown in the App. Plan allowances refresh each billing period and do not accumulate or carry over from period to period. We may raise an active subscriber’s allowance during a paid period; we will not lower what you were sold for a period you have already paid for.

Purchased render units are yours. Render units you buy outright (Project Pack and top-ups) remain available until you use them or delete your account. They are never reduced or expired by a plan-allowance refresh.

Auto-renewal (Apple App Store and Google Play).

• Payment is charged to your Apple ID or Google account at confirmation of purchase — or, for a subscription with a free trial, at the end of the trial unless you cancel at least 24 hours before the trial ends.
• Subscriptions automatically renew at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing and canceling. You manage and cancel subscriptions in your device’s store account settings — on iPhone: Settings → [your Apple ID] → Subscriptions; on Android: Google Play → Payments & subscriptions. Deleting the App does not cancel a subscription.
• Refunds. Payments are handled by the app stores, and refunds are governed by the applicable store’s policies. Except where required by law or store policy, purchases are non-refundable.
• These Terms and our Privacy Policy apply to all subscriptions and purchases.

5. Shopping and affiliate links

When you tap a product link, you leave the App and transact directly with a third-party merchant.

• We are not the seller. Prices, availability, descriptions, shipping, taxes, and returns are the merchant’s responsibility, and may differ from what appears in the App. Confirm all details with the merchant before buying.
• Affiliate disclosure. Roomcart participates in affiliate programs, which may include the Amazon Associates Program and other retail affiliate networks. We may earn a commission when you buy through the App. As an Amazon Associate, Roomcart earns from qualifying purchases. Earning a commission never changes your price. Merchants and their affiliate networks use cookies or click identifiers on their own properties to attribute purchases; attribution windows vary by merchant and program.
• Your primary product match is never sold. The top match is always the best algorithmic match for you; sponsored items appear only in clearly labeled “Sponsored” positions among alternates.
• Estimated budgets and totals in the App cover item prices and may not include delivery, tax, installation, or the cost of finishes shown. They are estimates, not guarantees.

6. Your content and the license you grant us

• You keep ownership of the photos and prompts you provide.
• You grant Roomcart a limited license to host, process, transform, and display your content solely to operate the App for you — for example, to generate renders, match products, and, where you choose to share, display a render you share. This license ends when you delete the content or your account, except for content already shared by you and for routine backups that expire on their normal cycle.
• You represent that you have the rights to the photos you upload, and that you have any necessary consent from people who appear in them. Do not upload photos of other people — especially children — without appropriate consent.

7. Acceptable use

You agree not to:

• attempt to bypass usage limits — including the one-time free render, trial eligibility, or fair-use limits — or anti-abuse controls (including by automation, multiple/fake accounts, or device spoofing);
• upload unlawful, infringing, or harmful content, or content you have no right to use;
• reverse engineer, scrape, or interfere with the App or its providers, except as permitted by law;
• use the App to build a competing product catalog or dataset.

We may throttle, suspend, or terminate access, and may apply progressive friction (such as quotas or verification), to protect the service.

8. AI content, reporting, and moderation

AI-generated renders may occasionally be inaccurate, unexpected, or unsuitable. Every render surface includes a way to report a generated image. We may review reported content and remove content or suspend accounts that violate these Terms.

9. Intellectual property

The App, its software, design, and branding are owned by Roomcart and its licensors and are protected by law. Except for your own content, nothing in these Terms grants you rights in the App. Product names and merchant marks belong to their respective owners.

10. Disclaimers

THE APP AND ALL RENDERS, MATCHES, PRICES, AND ESTIMATES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that renders are accurate, that a matched product is identical to what is shown, or that merchant prices or availability are current. Design suggestions are aesthetic aids, not professional design, engineering, or installation advice.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMCART AND GREAT DANE HOLDINGS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR PURCHASE OF PRODUCTS FROM THIRD-PARTY MERCHANTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100.

12. Indemnification

You agree to indemnify and hold Roomcart harmless from claims arising out of your content, your use of the App, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the App at any time and delete your account (see our Privacy Policy for how). We may suspend or terminate access if you violate these Terms or to protect the service. Sections that by their nature should survive termination (including §§6, 9–12, 14) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App that is not resolved informally shall be brought exclusively in the state or federal courts located in Lake County, Florida, and you consent to the jurisdiction and venue of those courts. Nothing in this section limits any non-waivable rights you may have under the consumer-protection laws of your state of residence.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the App. Continued use after changes take effect means you accept the updated Terms.
